PLEASE READ CAREFULLY. THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE, A CLASS-ACTION WAIVER, BROAD DISCLAIMERS OF WARRANTY, LIMITATIONS OF LIABILITY, AND YOUR AGREEMENT TO INDEMNIFY FIXFINDER. BY CREATING AN ACCOUNT OR USING FIXFINDER YOU ACCEPT THEM IN FULL.

1. Who we are and what FixFinder is

FixFinder ("FixFinder", "we", "us") operates an online marketplace at fixfinder.site (the "Platform") that lets homeowners and occupants ("Homeowners") describe repair or maintenance work and lets independent service providers ("Handymen"; together with Homeowners, "Users") offer quotes for that work. FixFinder is a technology venue only. FixFinder does not perform, supervise, direct, control, inspect, guarantee, or take responsibility for any work, quote, schedule, payment, or communication between Users.

2. No employment, agency, or partnership

Handymen are independent businesses and are not employees, agents, contractors, joint venturers, or representatives of FixFinder. FixFinder does not set prices, hours, methods, or tools; does not employ, train, license, bond, or insure Handymen; and does not verify the accuracy of any profile, license, insurance, rating, badge, "Vetted", "Streak Pro", response-time or punctuality indicator, all of which are informational only and may be based on self-reported or automatically generated data. Any contract for services is solely between the Homeowner and the Handyman.

3. Eligibility and accounts

You must be at least 18, legally able to contract, and provide accurate information. You are responsible for all activity under your account and for keeping your credentials secure. We may suspend or terminate any account at any time for any reason, including suspected fraud, abuse, or violation of these Terms.

4. Handyman responsibilities

  • You are solely responsible for holding every license, permit, certification, registration, bond, and insurance required by federal, state, and local law for the work you offer (including but not limited to electrical, plumbing, gas, HVAC, and locksmith work), and for complying with all building codes and safety regulations.
  • You are solely responsible for the quality, safety, legality, and timeliness of your work, for your tools and materials, for your own taxes, and for any employees or subcontractors you use.
  • You warrant that all information you provide, including quotes, testimonials, photos, and availability, is truthful and not misleading.

5. Homeowner responsibilities

  • You are solely responsible for selecting a Handyman, verifying their qualifications, licenses, and insurance to your own satisfaction, and deciding whether to allow them onto your property.
  • You are responsible for providing accurate job descriptions, a safe work environment, and lawful access to the property, and for obtaining any required permits or landlord/HOA approvals.
  • You assume all risk associated with admitting any person to your home or property.

6. Fees, payments, tips, credits

Homeowners pay Handymen through our third-party payment processor (Stripe). FixFinder retains a platform fee (currently 8% of the job price, reduced to 5% while a Handyman's streak reward is active) from each payment; the remainder is transferred to the Handyman's connected account. Tips go 100% to the Handyman. FixFinder is not a party to the payment, does not hold funds as an escrow or fiduciary, and is not responsible for payment-processor delays, holds, chargebacks, bank errors, or taxes. Referral credits, streak rewards, and other promotions are discretionary, have no cash value, may be changed or withdrawn at any time, and may be revoked for abuse. All fees are non-refundable except where required by law or expressly stated by FixFinder in writing.

7. Scheduling, cancellations, no-shows, warranties

Appointments become binding only between the Homeowner and Handyman when both confirm. Reminders, ETA notices, check-ins, no-show alerts, weather delays, recurring visits, and warranty reminders are convenience features provided "as is" and may fail or be delayed. Any workmanship warranty offered is the Handyman's alone; FixFinder offers no warranty on any work.

8. Disclaimer of warranties

THE PLATFORM AND ALL CONTENT, FEATURES, QUOTES, RATINGS, BADGES, ESTIMATES, MAPS, WEATHER DATA, NOTIFICATIONS, AND SERVICES PERFORMED BY HANDYMEN ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, OR THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. FIXFINDER MAKES NO WARRANTY REGARDING ANY HANDYMAN, HOMEOWNER, OR WORK PERFORMED.

9. Assumption of risk

You acknowledge that home repair involves inherent risks, including property damage, personal injury, death, fire, flood, electrical hazards, theft, and financial loss, and that interactions with other Users carry risk. You voluntarily assume all such risks and agree that FixFinder has no duty to screen Users, inspect work, or intervene in disputes.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXFINDER AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS (THE "FIXFINDER PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, PROPERTY, OR USE, OR FOR PERSONAL INJURY OR DEATH, ARISING OUT OF OR RELATED TO THE PLATFORM, ANY WORK PERFORMED OR NOT PERFORMED, ANY QUOTE, PAYMENT, DISPUTE, OR ANY CONDUCT OF ANY USER OR THIRD PARTY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY. IN NO EVENT SHALL THE FIXFINDER PARTIES' TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE PLATFORM FEES ACTUALLY RECEIVED BY FIXFINDER FROM YOU IN THE SIX (6) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

11. Release

If you have a dispute with one or more Users, you release the FixFinder Parties from all claims, demands, liabilities, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code §1542, and any similar law of any other jurisdiction.

12. Indemnification

You agree to defend, indemnify, and hold harmless the FixFinder Parties from and against any and all claims, suits, demands, losses, liabilities, damages, judgments, settlements, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) any work you perform, request, or receive; (c) your breach of these Terms or of any law, code, or regulation; (d) your negligence or willful misconduct; (e) any injury, death, or property damage caused by you or occurring on property you control; (f) any content you submit; (g) your failure to hold required licenses, permits, or insurance; or (h) any dispute between you and another User. FixFinder may assume the exclusive defense of any matter, and you agree to cooperate.

13. Content, reviews, testimonials, photos

You grant FixFinder a worldwide, royalty-free, perpetual, irrevocable license to host, display, reproduce, and adapt content you submit (including job photos, messages, reviews, and testimonials) to operate and promote the Platform. You are solely responsible for your content, warrant that it is truthful and that you have all rights to it, and agree not to post unlawful, defamatory, infringing, or misleading content. FixFinder may moderate or remove content at its discretion but has no obligation to do so.

14. Prohibited conduct

You may not circumvent Platform payments, harass or defraud Users, misrepresent identity or qualifications, scrape data, reverse-engineer the Platform, interfere with its security, or use it for any unlawful purpose.

15. Third-party services

The Platform relies on third parties (including Stripe, Google, Twilio, email and weather providers, and map data). FixFinder is not responsible for their acts, omissions, outages, or terms. Your use of those services is subject to their own terms.

16. Dispute resolution, arbitration, class-action waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform that cannot be resolved informally within 30 days after written notice shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in the county of FixFinder's principal place of business or remotely. YOU AND FIXFINDER EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Either party may bring individual claims in small-claims court. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.

17. Governing law

These Terms are governed by the laws of the State of [YOUR STATE], United States, without regard to conflict-of-law rules, and by the Federal Arbitration Act. Subject to Section 16, exclusive venue lies in the state and federal courts located in [YOUR COUNTY, YOUR STATE].

18. Changes, severability, entire agreement

We may update these Terms at any time by posting a revised version; continued use constitutes acceptance. If any provision is held unenforceable, the remainder stays in effect and the provision is enforced to the maximum extent permitted. These Terms, together with the Privacy Policy, are the entire agreement between you and FixFinder. Our failure to enforce any right is not a waiver.
